Terms of Service

Effective Date: March 6, 2026

1. Overview

These terms govern all website design, development, and hosting services provided by Pages by David ("we", "us", "the Company") to you ("Client", "you").

By signing up for any plan, you agree to these terms.

2. Plans & Pricing

  • 10-Slot Summer Build (through Labor Day 2026): $295/month with no setup fee and a 3-month starter commitment. Available to the first 10 contractors who sign up before Labor Day 2026 while we build case studies for the Contractor Credibility System. Includes a 5-page contractor website, hosting and SSL, done-for-you copywriting, Google Business Profile tune-up, Review Request Kit, project photo gallery, local SEO foundation, contact form and click-to-call setup, and ongoing content updates.
  • No Setup Plan: $295/month with a 12-month agreement. No setup fee. Same deliverables as the 10-Slot Summer Build. Available after the summer slots are filled.
  • Flex Plan: $695 one-time setup fee plus $295/month, month-to-month after launch. Same deliverables as the 10-Slot Summer Build.
  • Additional pages, custom sections, or anything in the "Not included unless quoted separately" list on our pricing page: quoted separately based on scope.

Prices will not change during your contract period. After your contract period, prices are subject to change with 60 days written notice.

Longer contract terms are available and can be negotiated on request.

3. Minimum Commitment & Cancellation

  • 10-Slot Summer Build: 3-month starter commitment. If you cancel during the 3-month starter, you owe the remainder of the starter ($295 multiplied by months remaining in the starter). After the 3-month starter, the plan is month-to-month with 60 days written notice and no further fee.
  • No Setup Plan: 12-month agreement. If you cancel before month 12, an early termination fee of $100 multiplied by the number of months remaining in the 12-month term applies (this recovers the unamortized portion of the build labor that the No Setup Plan would have collected over the full term). After month 12, the plan continues month-to-month with 60 days written notice and no further fee.
  • Flex Plan: No minimum commitment after launch. The $695 setup fee is non-refundable once the build begins. After launch, cancel anytime with 60 days written notice. No early termination fee.
  • Notice format: 60 days written notice means email or letter. Email to [email protected] is fine.

4. Code Ownership

Pages by David retains ownership of the website code, templates, and design system used across multiple client sites.

You own at all times: your domain, logo, brand assets, photos (including stock photos licensed for your use), written copy and content about your business, and customer data (form submissions, contact information).

Upon cancellation of any plan, the site is taken offline. We provide all your content and assets (copy, photos, logos, customer data, any other content authored about your business). The website code is not transferred.

If you specifically want to own the code outright, a one-time code buyout is available, quoted separately based on the build. Contact us for pricing.

5. Domain Ownership

Your domain is always yours. We will never hold a domain hostage.

If we register a domain on your behalf, it is registered in your name and transferred to you on request at no charge.

You are responsible for domain renewal fees.

6. What Counts as an "Edit"

An edit is a text change, photo swap, service update, phone/email change, gallery update, small layout adjustment, or testimonial and review addition. These are the items listed under "Included in monthly service" on our pricing page.

An edit is not a full redesign, new page, new section, layout overhaul, new functionality, paid ads, ongoing SEO campaign, blog writing, professional photography, automated SMS system, complex CRM or scheduling integration, logo or branding work, multi-location SEO, or large directory cleanup. These are the items listed under "Not included unless quoted separately" on our pricing page and are quoted separately based on scope.

Edits as defined above are completed within 1 business day on all plans.

7. SEO: What's Included & What's Not

SEO has two parts: on-page (everything on your website) and off-page (everything outside your website).

Included with all plans (on-page foundations):

  • Fast load times and mobile-responsive design
  • Accessibility best practices
  • Meta tags and descriptions
  • Google Search Console submission
  • Sitemap generation
  • Initial content creation

Not included (ongoing SEO):

  • Link building and guest posting
  • Local citations and directory submissions
  • Content marketing and keyword strategy

SEO is an active, ongoing process that goes beyond what's built into your website. Off-page work is separate from website packages.

8. What's Not Included

The following are not included in any plan and are either quoted separately or sourced from third parties. This list mirrors the "Not included unless quoted separately" list on our pricing page:

  • Full redesigns or layout overhauls beyond the original scope
  • Paid ads (Google Ads, Meta, etc.)
  • Ongoing SEO campaigns (off-page link building, content marketing, paid citations)
  • Blog writing or ongoing content production
  • Professional photography or video production
  • Automated SMS review systems
  • Complex integrations (CRMs, scheduling tools, custom APIs)
  • Logo design or brand identity work
  • Multi-location SEO
  • Large directory cleanup
  • Copywriting beyond the initial site build (done-for-you copywriting covers the initial 5-page build only)
  • E-commerce, online booking, or payment processing features beyond standard contact and click-to-call
  • Third-party costs: domain registration, Google Workspace, email marketing tools

9. Hosting & Uptime

Your site is hosted on Cloudflare, a global infrastructure provider used by millions of websites including Fortune 500 companies. Cloudflare operates data centers in 300+ cities worldwide with built-in DDoS protection, SSL encryption, and a global CDN.

We make every reasonable effort to keep your site online and resolve issues promptly.

We do not guarantee 100% uptime. Brief downtime may occur during updates or due to circumstances beyond our control. Pages by David is not liable for lost revenue or business due to downtime.

10. Payment Terms

  • All payments are processed through Stripe. We accept all major credit and debit cards.
  • Monthly payments are billed on the same date each month.
  • Invoices not paid within 7 days incur a $25 late fee.
  • If payment is not received within the 7-day grace period, your site will be taken offline until the balance is resolved.
  • All payments are non-refundable.

11. Content & Acceptable Use

You are responsible for the content on your website.

We reserve the right to refuse to publish content that is illegal, defamatory, fraudulent, or otherwise harmful.

We may remove content that violates these terms without prior notice.

12. Portfolio & Testimonial Rights

We may display your website in our portfolio, marketing materials, and case studies unless you opt out in writing.

This includes screenshots, descriptions, and links to your live site.

13. Support Hours

Support requests are handled within 1 business day (Monday through Friday, excluding federal holidays).

We are not available for emergency support outside business hours. If your site goes down overnight or on a weekend, we will address it on the next business day.

14. Changes to These Terms

We may update these terms with 60 days written notice.

Continued use of the service after notice constitutes acceptance.
